Terms and Conditions of Use

These Terms and Conditions govern access to and use of the website atlantic-advisory.pt (the "Website"). By accessing or using the Website, you confirm that you have read, understood and accepted these Terms in full. If you do not agree with them, please do not use the Website.

1.Service provider identification

In compliance with Article 10 of Portuguese Decree-Law no. 7/2004 of 7 January (electronic commerce), the following information is provided:

2.Purpose and scope

The Website is informational and institutional in nature. It presents Atlantic Advisory's activity, services and team, and enables contact with prospective clients, candidates and other interested parties. These Terms do not govern the provision of professional services, which is the subject of a separate written agreement with each client that prevails over these Terms in the event of any conflict.

3.Use of the Website

You undertake to use the Website in accordance with the law, good faith and these Terms, and in particular not to:

  • use the Website for unlawful purposes, to the detriment of third-party rights or contrary to public policy;
  • introduce or spread viruses, malicious code or any element capable of damaging IT systems;
  • attempt unauthorised access to restricted areas, servers or databases associated with the Website;
  • carry out automated, bulk or systematic extraction of content (scraping, data mining) without written authorisation;
  • use the forms or contact addresses to send unsolicited commercial communications.

4.Intellectual and industrial property

All Website content — including text, images, photographs, video, graphics, logos, trade marks, trade names, structure, source code and design — is the property of Atlantic Edge Universal Advisors, Lda or of third parties who have authorised its use, and is protected by the Portuguese Copyright and Related Rights Code and the Industrial Property Code.

You may consult, view and print content for personal, non-commercial use. Reproduction, distribution, adaptation, public communication or any other form of exploitation, in whole or in part, is expressly prohibited without our prior written consent. Quotation for informational or academic purposes is permitted provided the source is credited and a link to the original page is included.

5.Information provided and professional advice

The information on the Website, including articles, briefings, guides and legislative commentary, is general and purely informational, is prepared on the basis of the framework in force at the date of publication, and does not constitute accounting, tax, legal or financial advice applicable to any specific situation.

No decision should be taken solely on the basis of the information provided here, without appropriate professional advice. Consulting the Website or sending a message through the available forms does not in itself create any service relationship between you and Atlantic Advisory, which arises only upon express written acceptance of a proposal or agreement.

6.Availability and limitation of liability

We use our best efforts to keep the Website available, up to date and error-free, but we do not warrant the absence of interruptions, technical faults, inaccuracies or outdated content. We reserve the right to suspend, modify or discontinue, in whole or in part and at any time, access to the Website or any of its content, without prior notice.

To the extent permitted by law, we are not liable for indirect damage, loss of profits, loss of data or loss of business opportunities arising from access to, or inability to access, the Website, or from use of the information it contains. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, in particular in cases of wilful misconduct or gross negligence, or towards consumers.

7.Third-party links

The Website may contain links to third-party websites, provided solely for your convenience. We do not control and accept no responsibility for their content, policies or practices. The presence of a link does not imply any association, sponsorship or endorsement. Linking to the Website is permitted provided it does not misleadingly suggest a relationship that does not exist and does not reproduce our content outside its context.

8.Data protection and cookies

The processing of personal data through the Website is governed by our Privacy Policy, and the use of cookies by our Cookie Policy, both of which form an integral part of these Terms.

9.Professional secrecy

Atlantic Advisory's activity is subject to the applicable professional secrecy duties, in particular those laid down in the Statute of the Portuguese Order of Certified Accountants for registered professionals, without prejudice to statutory reporting duties under anti-money laundering and counter-terrorist financing legislation (Law no. 83/2017 of 18 August).

10.Complaints and alternative dispute resolution

You may submit a complaint directly to geral@atlantic-advisory.pt or through the Electronic Complaints Book at www.livroreclamacoes.pt.

In consumer disputes, consumers may refer the matter to an alternative dispute resolution body under Portuguese Law no. 144/2015 of 8 September:

11.Changes to these Terms

We reserve the right to amend these Terms at any time. The version in force is always the one published on this page, with its date, and applies to any access occurring after publication.

12.Governing law and jurisdiction

These Terms are governed by Portuguese law. Any dispute arising from their interpretation or performance shall be submitted to the courts of the district of the registered office of Atlantic Edge Universal Advisors, Lda, with express waiver of any other, without prejudice to the mandatory jurisdiction rules applicable to consumers.

If any provision of these Terms is held invalid or unenforceable, this shall not affect the validity of the remaining provisions, which shall remain in force.
